A la hora de hacer el análisis previo a la radicación de la planilla de contribución sobre ingresos, muchas personas se preguntan si un dependiente puede generar ingresos. Esto es muy importante ya que la cantidad de ingresos recibida será un factor determinante a la hora de decidir si usted lo puede o no reclamar como dependiente. Aunque bastante conocida, dicha exención tiene unas limitaciones y requisitos que todo contribuyente debe tener presente a la hora de preparar su planilla de contribución sobre ingresos de individuos 2017.
Lo primero que tenemos que considerar es lo siguiente: ¿Quién cualifica como dependiente? Para propósitos contributivos un dependiente es unos de los siguientes:
- una persona que al terminar el año no haya cumplido sus 21 años, o 26 años si fue estudiante universitario al menos durante un semestre del año;
- los padres del contribuyente;
- una persona de 65 años o más; o
- una persona ciega o legalmente incapacitada
Cualquiera de estas personas podría ser reclamada como dependiente siempre y cuando haya recibido del contribuyente más de la mitad de su sustento durante el año contributivo en cuestión y, como regla general, sea ciudadano de los Estados Unidos. Sin embargo, una persona que tiene la obligación de rendir una planilla en conjunto con su cónyuge, no cualifica como dependiente.
Es importante destacar que en el caso de que una persona cualifique como dependiente para un año contributivo y ésta haya generado ingresos durante dicho año, su ingreso bruto del año no puede exceder la cantidad de $2,500 para que pueda ser reclamado como dependiente. No obstante, en el caso de un menor de edad que fue estudiante regular durante el año, éste podrá devengar un ingreso bruto por servicios prestados de hasta $7,500, sin que sus padres pierdan el derecho a reclamarlo como dependiente.
Ahora usted se preguntará: ¿Y qué constituye ingreso? Ingreso bruto consiste de todo ingreso, ganancia o beneficio recibido o derivado de cualquier procedencia, tales como salario, ingresos de profesiones, negocios, ventas, pensiones, anualidades, sucesiones, fideicomisos, ingreso de intereses, dividendos, beneficios de sociedades, entre otros. Tenga en cuenta que no se catalogan como “ingreso bruto” las cantidades recibidas bajo un contrato de seguro de vida pagadas por razón de muerte del asegurado, donaciones recibidas, herencias, compensación por lesiones o enfermedad, beneficio de Seguro Social federal, ni las cantidades pagadas por un patrono por reembolso de gastos de viaje, comidas, hospedajes, entre otros.
A pesar de lo anterior, si al dependiente se le retuvo contribución sobre ingresos, éste deberá rendir una planilla para que se le reintegre la contribución retenida. Cabe señalar que todo ingreso recibido por un menor por la prestación de un servicio deberá ser incluido como parte del ingreso bruto de éste y no en el de sus padres. Sin embargo, los ingresos pasivos tales como intereses, dividendos, donativos, premios, rifas, entre otros, no formarán parte del ingreso bruto del menor. Por lo tanto, estos ingresos sí deberán ser reportados en la planilla de sus padres.
